Purafy Warranty

PURAFY Clean Technologies Inc. (“PURAFY”) warrants its products to be free from defects in material or workmanship for a period of 12 months from delivery when the products are used in Canada (unless PURAFY expressly agrees that this warranty applies when the products are used outside Canada) by the original purchaser under normal use and service. PURAFY also requires that the products are registered with PURAFY (www.purafy.com/warranty_registration) within 90 days from delivery for this warranty to apply to its products. This warranty does not apply to replaceable parts or components subject to normal wear and replacement.

Unless specifically stated in the applicable contract, the warranty excludes any claims arising from (i) installation or use of the products in a manner not set forth in the written instructions that PURAFY provides with the product, namely the Operating Manual, (ii) any modifications or damage to the product not made or caused by PURAFY, (iii) non-compliance with federal, provincial, state and local codes or ordinances or other special codes not specifically stated in writing on the purchase document or contract, and (iv) performance or results of the products.

The customer must contact PURAFY at www.purafy.com/warranty_claim and provide the information requested in order for the customer to request remedy for breach of warranty of their registered products. The customer will receive an email from PURAFY within 10 business days of the customer contacting PURAFY. This email will inform the customer of the status of the warranty claim.

The customer’s sole and exclusive remedy for breach of warranty concerning products will be repair or replacement of the defective portion thereof or a refund to the customer, in PURAFY’s sole discretion. Parts or components may be replaced as deemed necessary solely at PURAFY’s discretion, with the returnable part or components becoming the property of PURAFY, PURAFY would be responsible for any transportation and disposal of these parts, PURAFY does not warrant that products will operate uninterrupted or error free or that non-material defects will be corrected. This warranty does not apply to any malfunction, failure or defect caused by: failure of the user to provide a suitable operating environment, installation or use of products for a purpose or in a manner other than that, for which they were designed, or any other abuse (including overloading of the product beyond its capacity), misuse, accidents, improper maintenance or storage, or neglect of the products.

EXCEPT FOR THESE EXPRESS WARRANTIES, TO THE EXTENT PERMITTED BY APPLICABLE LAW, PURAFY CLEAN TECHNOLOGIES, ITS SUPPLIERS, LICENSORS, AND REPRESENTATIVES SPECIFICALLY DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, IN FACT OR BY LAW, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY, QUALITY, OR FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGMENT.

IN NO EVENT WILL PURAFY OR ITS SUPPLIERS, LICENSORS, OR REPRESENTATIVES BE LIABLE TO THE CUSTOMER OR ANYONE ELSE, FOR INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OR FOR LOST PROFITS OR REVENUE, LOSS OF USE OF THE PRODUCTS OR RELATED MATERIALS, LOSS OF DATA, THE COST OF RECOVERING SUCH PRODUCTS, RELATED MATERIALS OR DATA OR, THE COST OF ANY SUBSTITUTE PRODUCTS OR MATERIALS, ARISING FROM ANY BREACH, OR THE SALE, LICENSE, USE OF, OR INABILITY TO USE THE PRODUCTS, OR RELATED MATERIALS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, REGARDLESS OF THE FORM OF ACTION, WHETHER CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT PRODUCT LIABILITY, OR OTHERWISE.

In no event shall PURAFY’s aggregate liability, including damages, arising in connection with a product exceed the price paid to PURAFY for such product.

To the extent permitted by applicable law, all implied warranties, including warranties of merchantability or fitness for particular purpose, are disclaimed. Any implied warranties, including warranties for merchantability or fitness for a particular purpose, that cannot be disclaimed are limited to the applicable warranty period defined at the beginning of this document.
